1. Who are we?

2. Scope

These terms apply to the use of this website and the purchase of a Marketomato subscription through this site. Use of the Marketomato application itself is subject to the additional Marketomato terms of use (at marketomato.multomato.com), which you accept upon activation. In the event of a conflict, the service terms take precedence for use of the app.

3. For businesses only

Marketomato and this site are intended exclusively for businesses and professional users, not consumers or minors. By making a purchase, you declare that you are acting for professional or business purposes.

4. Subscriptions, pricing and payment

  • Marketomato is available through paid subscriptions (Starter and Standard, and future plans such as Growth and Pro), as described on the site. Prices exclude VAT unless otherwise stated.
  • Invoicing and payment are handled through our invoicing and payment partner. Recurring payments are set up only when you personally confirm a plan and billing period (monthly or annual) and make the payment. Before confirming, you will always see the exact amount, VAT and payment frequency.
  • Subscriptions renew automatically for the same period unless you cancel in time: the monthly option can be cancelled each month; for the annual option, you can cancel no later than 30 days before the renewal date.
  • Amounts paid for a current period are non-refundable unless mandatory law provides otherwise.
  • We may change prices or plan features for a valid reason; we will notify existing customers of material changes at least 30 days in advance, with the right to cancel before the changes take effect.
  • In the event of non-payment, we may suspend access after giving prior notice, without affecting any outstanding payment obligations.
  • If we offer a free trial, the special rules in section 5 apply.

5. Free trial

  • Your trial only starts once you have successfully activated your email address using the activation email. From that point, you can use Marketomato free of charge for thirty calendar days, with the features of the plan you selected when applying (Starter or Standard).
  • No credit or debit card is required to start the trial, and no payment is needed. Prices on this site exclude VAT.
  • If you have not expressly confirmed and paid for a paid plan and billing period by the end date, no automatic payment is taken and no debt arises. Access to the app simply ends.
  • At any time during your trial, you can select Starter or Standard with monthly or annual billing within the application itself. You are then taken to our secure payment page. Until you make that choice, no payment card is needed and no payment is collected.
  • Before you confirm, we show you the exact amount, VAT and payment frequency. Payment is taken only after that explicit instruction: the monthly amount for monthly billing, or the full annual amount with the annual saving for annual billing. Your paid subscription starts as soon as the payment is confirmed.
  • The subscription then renews automatically according to the confirmed billing option until you cancel under section 7. If you later change your plan or billing period, we ask you to clearly confirm the amount and frequency again.
  • If a payment fails or is not made, you will not receive paid access. Account & billing remains accessible so you can resolve this for as long as your account details are retained under our retention policy.
  • Each company can have no more than one Marketomato trial within the applicable three-year period. We check this using a limited, pseudonymous verification value derived from your normalised company registration or VAT number; we do not use card details for this purpose.
  • We retain this verification value for a maximum of three years from the end of your trial, or from the later end of the customer relationship if it lasts longer. It is then deleted automatically. A company without an active subscription can then apply for another trial; this is not an automatic entitlement, and we may refuse in the event of abuse or reasonable suspicion of abuse. A company with an active paid subscription is not eligible for a new trial.
  • When the trial expires, automated processing stops: nothing more is generated or published.
  • If you do not take out a paid subscription, your workspace and content may be retained for up to ninety calendar days after the trial ends to allow restoration. We then delete them. Once the corresponding automatic notification is operational, we will send an email warning before deletion with the exact date. Invoices and statutory accounting records are subject to statutory retention periods; the anti-abuse verification value follows its own retention period of up to three years.
  • The same usage rules and restrictions apply during the trial as for paying customers, on the understanding that the service is provided free of charge and no availability or performance guarantee applies.
  • We may refuse, restrict or end a trial early in the event of abuse, reasonable suspicion of abuse, repeated requests for the same company or a breach of these terms. We will notify you at the email address provided.

6. Use of the website

You must not use this site in a way that harms its operation or security, or in breach of the law. The site’s content, trademarks and design are the property of Multomato Systems.

7. Cancellation and refunds

  • If you have not confirmed and paid for a paid plan during your trial, there is nothing to cancel: no subscription is created and no payment is collected. Access ends automatically on the end date.
  • The monthly option can be cancelled each month. Cancellation takes effect at the end of the current paid period.
  • The annual option renews automatically for the same period. You can cancel no later than 30 days before the renewal date. If you cancel later, the subscription continues until the end of the paid period then in progress.
  • Current periods that have already been paid for are non-refundable unless mandatory law provides otherwise.
  • Once Account & billing supports this in the app, you will be able to cancel through your account. Until then, cancel by sending an email to support@multomato.com from the account holder’s email address. We will confirm your cancellation by email.
  • To the extent that mandatory consumer protection does apply, it remains fully effective. Business customers have no right of withdrawal.

8. Liability

To the extent permitted by law, our liability is limited to direct, proven damage caused by a fault attributable to Multomato. This limitation does not apply to wilful misconduct, fraud, gross negligence or failure to perform essential obligations. The liability provisions in the Marketomato terms of use apply to use of the app.

9. Governing law

Belgian law. Disputes fall within the jurisdiction of the Antwerp Enterprise Court, Mechelen division, unless mandatory law provides otherwise.
